Adaptation of the provision of the public service of justice to the extension of the state of alarm.
The Minister of Justice adapts the provision of the service to the 15-day extension of the state of alarm in which the criteria for qualified confinement provided for in RDL 10/2020 no longer apply.
In order to ensure the proper functioning of the Administration of Justice as a public service during the state of alarm, the following services must be provided in any case:
a. The essential ones in the original conditions contemplated in the Resolution of the Secretary of State for Justice, and the corresponding resolutions of the General Council of the Judiciary and the State Attorney General’s Office of 14-3-2020.
b. The registration of all writs filed in the judicial and prosecutors’ offices telematically (LexNET or equivalent systems in the Basque Country, Catalonia, Navarre, Cantabria and Aragon), and their distribution to the competent bodies, to ensure the proper functioning of courts and tribunals. For this purpose, it is recommended that lawyers, solicitors and social graduates should be weighted or moderate in the filing of pleadings in order to make the distribution more feasible.
c. Carry all non-essential procedures as long as available means permit.
d. To carry out in the shortest possible time all death and birth registrations submitted, as well as the handling of Civil Registry procedures not included in the category of essential services whenever the available means allow it.
To this end, the public service of justice must be provided through the following modalities:
– shift work;
– full availability of personnel who are not required to attend work, who may be required for the provision of any service that cannot be performed remotely or for any incident that may arise in connection with essential services;
– teleworking of personnel who have devices with secure access to procedural management systems and applications provided by the administration or, failing that, can voluntarily provide the service under similar conditions with personal devices.
