Instructions necessary for the participation of the workers in the elections to the European Parliament, in the local elections and the General Council of Aran of the day 26/05/2019
The Order 82 of April 26, 2019 (DOGC 02/05/2019) regulates the participation of the workers who on the day of the elections do not enjoy the weekly rest on May 26, 2019 regarding:
Non-recoverable and paid leave of four hours if it coincides with your working day.
Partial coincidence with working hours:
• If the match is at most two hours: there is no permission.
• If it coincides more than two hours and less than four hours: two hours permit.
• If it coincides more than four hours or more: general permission of four hours.
The determination of the moment of use of the hours granted for the vote, which must coincide with the schedule established by the electoral college, is the employer’s power.
Companies have the right to ask their workers to show proof of having voted, issued by the corresponding polling station.
A. Permission of polling station members, inspectors and representatives.
• Election board members and inspectors: they must be granted the corresponding permission for the full day of that day and, in addition, a permit corresponding to the first five hours of the working day of the immediately following day, of a non-recoverable nature and paid by the company once justified acting as a board member or auditor.
• Representatives: Companies must grant paid leave during the full day of May 26 and not recoverable.
If any of the workers had to work in the night shift on the date immediately before the election day, the company, at the request of the person concerned, must change the shift so that he can rest the night before the elections.
B. Permission to formulate the certification request to exercise the vote by mail.
A permit, paid and of a non-recoverable nature, of a maximum of four free hours, within the working day that corresponds to them, will be granted to workers who perform functions far from their habitual residence or in other conditions from which difficulties arise. to exercise the right to vote on May 26, 2019, so that they can personally formulate the necessary certification request to be able to cast their vote by mail.
This permission can be requested until May 16, 2019, according to the criteria of coincidence of the opening of the polling stations and the working day.
