Road transport: control of driving and rest times
On 3-22-2022, the Land Transport DG Resol 3-18-22 has been published , which establishes the rules for minimum controls on the working hours of drivers in road transport, which are They will be carried out at the company’s premises and on the road.
Control systems are established for the working hours of drivers of goods and passenger road transport vehicles. The controls will reach 3% of the drivers’ working hours and will be carried out both on the road and at the company’s premises in accordance with the following criteria:
1. Road control :
- They will account for at least 30% of the controls;
- It must be done without any discrimination as to the country where the vehicle is registered, the driver’s country of residence, the country where the company is established, the origin and destination of the journey or the type of tachograph, analog or digital;
- In relation to the working day, the following will be checked: daily and weekly driving times, breaks and daily and weekly rest periods; the record sheets of the previous days that must be on board the vehicle and/or the data stored corresponding to the same period in the driver card and/or in the memory of the control device, and/or printouts on paper.
2. Control at the company’s premises :
- They will account for at least 50% of the controls;
In addition to the aspects verified on the road, the following will be controlled: the weekly rest periods and the driving times between said rest periods, the fortnightly limit of driving times, the record sheets, the data and the printouts on paper of the driver’s card and the unit installed in the vehicle, as well as the observance of the obligations of the companies regarding the payment of accommodation for drivers and the organization of their work.
