The objective dismissal is repealed for lack of work assistance
Royal Decree-Law 4/2020 of February 18 has been published, repealing the objective dismissal for lack of assistance to work established in article 52.d) of the consolidated text of the Law of the Statute of Workers , approved by Royal Legislative Decree 2/2015, of October 23 (EDL 2020/3267).
This rule addresses the issue of dismissal due to absenteeism, which is of great importance because it forces you to confront, on the one hand, the legitimate interest of the company to have the necessary workforce for the development of the business project and not have to assume the costs derived from their lack and, on the other, the right of working people not to be penalized for personal circumstances for which they are not responsible, such as those related to the disease.
